Surveillance Saves the Day

“Let’s go to the videotape.” It may seem like a cliché, but our clients were very glad to see the evidence Rissman attorneys Art Young and Meredith Stephens came up with in a recent slip-and-fall case.

The plaintiff claimed that he fell—hitting his back, neck, and head—at our client’s location due to water that was leaking from the suite above. The plaintiff claimed he sustained shoulder and cervical disc injuries, and he subsequently couldn’t participate in his family housekeeping business.

Our defense presented surveillance footage that showed the plaintiff moving freely, using both hands and bending at the waist at an office where his wife provided cleaning services. Additionally, our expert radiologist testified there were no objective findings of an acute injury to the plaintiff’s cervical spine or shoulder related to the incident.

Thanks to hard evidence and convincing testimony, our client got the verdict they wanted. All in a day’s work.
